Healthcare attorneys Roger Cohen and Simone Otenaike published an article addressing the impending (May 11, 2023) expiration of telehealth regulatory waivers issued by CMS in response to the COVID-19 pandemic. 

When the regulatory waivers expire, a few key issues are expected to surface including: 

  • The potential reinstatement of an in-person examination requirement for medical providers to be able to prescribe controlled substances
  • Changes in state medical practice laws and telehealth standards
  • Availability of health insurance coverage for telehealth services
